Ody, operated by Origns Inc. ("Ody", "we", "us", or "our"), is dedicated to providing a safe way for businesses to call, text, and be reached by their customers. In order to achieve that goal, we do not permit certain types of content, messaging, or calling on our platform, and we ask that the unlimited calling and texting included in every plan be used the way it is meant to be used: for real conversations with the people your business serves.
This Fair Use Policy is meant to ensure that our users, their customers, and the shared carrier infrastructure every Ody number depends on stay protected. All capitalized terms used herein without definition have the meanings set forth in Ody's Terms of Service, available at ody.co/terms, into which this Fair Use Policy is incorporated by reference.
Ody reserves the right to impose limits on, charge metered usage fees for, or terminate your use of the Services at any time in our discretion if we reasonably believe that your usage, including but not limited to the total number of text messages you send, the number of calls you place, the share of your outbound calls and texts that receive no answer or reply, and the number of devices or users you operate, is not consistent with normal, fair, and reasonable use of the Services, or breaches any rule in this Fair Use Policy.
Whenever reasonably possible, we will give you written notice of your excess usage or breach of the rules contained herein before taking any such action, and allow a reasonable period for you to modify your use.
1.What Unlimited Calling and Texting Covers
Every Ody plan includes unlimited calling and texting to and from the United States and Canada. That inclusion rests on one assumption: that your account is holding two-way conversations. Customers call and text your business, your team calls and texts them back, most calls connect, and most messages get an answer. Appointment reminders, follow-ups with existing customers, quotes, confirmations, a slow week of voicemails, and a busy season of inbound inquiries are all normal, fair, and reasonable use and are never metered.
Carriers charge for every call attempt and every message segment, whether or not anyone picks up or replies, and the registered messaging campaigns (10DLC) that every Ody number sends through are rated by the carriers on how recipients respond. An account that is mostly broadcasting to people who have not asked to hear from it therefore costs materially more to run than a conversing account and puts the deliverability of every other Ody customer at risk. The sections below describe how we identify that pattern and what happens when we do.
Inbound calls and inbound texts are always included and are never counted toward any limit or metered charge under this Policy. Calls placed by Ody's AI receptionist and AI calling features are covered separately by AI credits, as described in the Terms of Service and on the pricing page, and are not part of the measure described in Section 2.
2.Outbound Usage Review and Metered Usage Billing
We review each account's outbound calls and outbound text messages over a rolling thirty (30) day period, and we may look at longer or shorter periods where the pattern of use warrants it. In that review we consider, in particular:
- The share of outbound calls that were not picked up by the person called (no answer, busy, failed, or canceled before connecting).
- The share of outbound text messages that received no reply, meaning no text or call back on that conversation within a reasonable time after the message was sent.
- The share of outbound calls and texts that were a first contact with a phone number that had never called or texted your account before.
- The total number of outbound attempts, so that a small number of events is never treated as a pattern.
An account in which a substantial share of recent outbound attempts falls into those categories is considered above the threshold in this Fair Use Policy. We do not publish the exact threshold. It is set so that ordinary business use, including outreach to your own customers, stays well clear of it, and it is reviewed by a person at Ody before any decision is made. No account is ever placed on metered usage billing automatically.
a. Notice
If, after review, we decide to apply metered usage billing to an account, we will notify the workspace owner and every workspace admin by email at the addresses on file. The notice states the date from which metered usage billing applies, the prices in Section 2(b), where the usage can be seen in the product, and how to reach us for a human review. Metered usage billing applies only to calls placed and messages sent on or after the date stated in the notice. Nothing is charged retroactively.
b. Prices
While metered usage billing applies to an account, the following fees are charged in addition to the account's plan and any add-ons:
Outbound call placed: $0.50 (fifty cents) per call attempt, whether or not the call is answered.
Outbound text message sent: $0.20 (twenty cents) per message accepted by the carrier, counted per message rather than per segment. Messages the carrier rejects are not charged.
Inbound calls and texts: No charge.
c. How metered usage is collected
Metered usage accrues against a prepaid usage balance on the account. Whenever the accrued usage exceeds the balance, Ody charges the payment method on file for the account in blocks of $20 (twenty US dollars), or the smallest multiple of $20 that covers the amount owed, and credits the balance by the amount charged. Each block is a separate charge that appears on your card statement and as its own invoice in your billing history. Any unused portion of the balance carries forward and is applied to future metered usage on the account. Ody does not refund an unused prepaid balance except where required by law or as described in the Terms of Service.
d. Where to see it
While metered usage billing applies, your workspace shows a Metered usage billing section under Settings and Usage billing listing each metered call and message, the current prepaid balance, the amount about to be charged, and every block charge to date. The section is visible to all members of the workspace. Block charges also appear under Settings, Billing, and Billing history as separate invoices.
e. Declined charges
If a block charge is declined, your calls and texts continue to work. We will retry the payment method on file periodically and show a notice in the Metered usage billing section until the charge succeeds. You may update your payment method at any time under Settings and Billing. A balance that remains unpaid is a debt owed to Origns Inc. under the Terms of Service, and persistent non-payment may result in suspension of the account as described in Section 5.
f. Review and removal
You may ask for a human review at any time by replying to the notice email or by contacting [email protected]. If your use of the Services returns to normal, fair, and reasonable use for a sustained period, we may remove metered usage billing from your account; we will notify the workspace owner and admins when we do. Removal is not retroactive, and metered usage already accrued remains payable.
Metered usage billing under this Section 2 is a usage fee, not a penalty, and is independent of our rights under Sections 3, 4, and 5. Use that breaches the rules in Sections 3 or 4 may be metered, limited, suspended, or terminated regardless of whether it is above the threshold described in this Section.

You remain responsible for obtaining and keeping records of the recipient's consent as required by the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and the carriers' 10DLC policies.

5.Enforcement
If we reasonably believe that your use of the Services is not normal, fair, and reasonable, or breaches any rule in this Fair Use Policy, we may take one or more of the following actions, in our discretion and in proportion to the conduct involved:
- Contact you in writing to describe the usage or conduct and request that you modify it within a reasonable period;
- Apply metered usage billing to the account as described in Section 2;
- Impose limits on the number of calls, messages, numbers, devices, or users the account may use;
- Pause outbound messaging or calling on one or more numbers while a complaint, carrier notice, or legal request is investigated;
- Suspend or terminate the account in accordance with the Terms of Service, including, in cases of fraud, illegal content, or a credible threat to others, without prior notice.
Carriers, aggregators, and The Campaign Registry may independently suspend a messaging campaign or block traffic from a number based on recipient complaints or their own policies. Ody will pass on any such notice it receives, but cannot override those decisions and is not liable for the resulting interruption.
Nothing in this Fair Use Policy limits any other right or remedy available to Origns Inc. under the Terms of Service or applicable law, and you remain responsible for all fees accrued, including metered usage fees, up to the date of suspension or termination.
6.Changes to this Policy
We may update this Fair Use Policy from time to time, including the prices and block size in Section 2, to reflect changes in carrier costs, regulation, or the Services. When we do, we will update the Last Modified date above and, for material changes, notify workspace owners by email or through the product before the change takes effect. Your continued use of the Services after the effective date of an updated Policy constitutes acceptance of it.
